Pannone Lopes Devereaux & O’Gara Attorney Bruce H. Tobey to Present National Webcast on “P3 Opportunities for Water Utility Energy Projects”

Pannone Lopes Devereaux & O’Gara LLC (PLDO) Of Counsel Bruce H. Tobey, a leading water law authority and principal investigator of a national study entitled “Public-Private Partnership Opportunities for Water and Water Resource Recovery Utility Energy Projects,” will address the report’s findings during a webcast on Thursday, September 28, 2017 from 3 p.m. to 4 p.m. ET.

Attorney Tobey will be joined by Emily Hammond of the George Washington University Law School and Sean McGinnis of The Horinko Group. The national study was commissioned by the Water Research Foundation (WRF) in partnership with the Water Environment & Reuse Foundation with the goal of better positioning utilities to identify opportunities and undertake energy projects through public-private partnerships (P3s) to achieve their infrastructure needs in the most financially and environmentally effective manner.

Attorney Tobey and his co-presenters will highlight the characteristics, challenges, barriers, risks, incentives and benefits associated with P3 energy initiatives by providing real-world insights on legal, financing, contracting and risk management practices through case studies and information gained through the project investigation. The team will also review and describe relevant energy projects and P3 issues, including contractual drafting and structuring, and monitoring and oversight. “At a time when water and wastewater utilities need to make smart investments to improve their facilities and ensure their sustainability, WRF is providing the industry with a very timely report,” said Attorney Tobey. “It shows these utilities the way forward to become energy self-sufficient through sound uses of the P3 tool.”

Attorney Tobey is a prominent infrastructure practitioner and nationally recognized as a legal advisor on alternative project delivery models and financing for municipalities and private companies with a concentration in environmental and water law, P3s, and other business development opportunities for sustainable communities. With more than 30 years of both public and private sector experience, Attorney Tobey is a frequent guest speaker at national trade association events, and has testified before the U.S. House of Representatives Transportation and Infrastructure Committee’s P3 Panel. In 2014, he was the co-author of a landmark study and best practices guide for the nation’s water utility provider industry on legal protection and claims management issues before, during, and after infrastructure failure events entitled, “Water Utility Legal Protection and Claims Management from Infrastructure Failure,” which was also a WRF project.
